These terms are the agreement between you and John Gillespie (“Kestrel”, “we”) covering your use of the Kestrel app. They are written to be read. Where something works against you — and a few things do — we have tried to say so plainly rather than bury it.
You must be 18 or older to hold an account. We pay real money, which means identity verification, tax reporting and a binding contract — none of which we can do with a minor. One account per person. You are responsible for what happens under your account.
Kestrel is an advertising-funded short-video feed. Advertisers pay to have their clips shown and watched, and we share a percentage of the net revenue with the person watching. That is the entire product.
This is not employment. You are not our employee, contractor, or agent, and nothing here creates those relationships. There is no obligation on you to watch anything, and no obligation on us to have anything for you to watch.
Every campaign buys a specific event — a two-second viewable impression, a six-second view, a completed clip, a survey answer, or a conversion. You are credited when that event is met, and not before. Scroll past a clip early and neither you nor the advertiser is charged.
Your balance is a record of credits you have earned. It is not a bank account, not a deposit, and not transferable. It earns no interest, cannot be sold, gifted or moved between accounts, and has no value outside the app until it is paid out.
Balances below the payout minimum are forfeited if your account closes, whether you close it or we do. If you are near the threshold and thinking about leaving, cash out first. We will say this again in the app before you confirm deletion.
The following will get your account suspended and any unpaid balance withheld:
Advertisers audit what they buy, and they reverse payment for views judged invalid. When that happens we may reverse the corresponding credits, withhold a pending payout, or suspend an account while we investigate. We will tell you what happened and you can dispute it by writing to us. We are not going to pretend this is a neutral process — we decide, and our decision is final — but we will explain it.
Clips in the feed come from advertisers, creators and ad networks. We do not endorse what they sell. Sponsored content is labelled. If you buy something through an offer, that transaction is between you and the advertiser, and their terms and refund policy apply, not ours.
Covered in full by our Privacy Policy, which forms part of these terms. In short: advertising identifiers and view events are shared with ad partners, optional data is opt-in and revocable, and you can delete your account from within the app.
We may change these terms, the revenue share, the payout minimum or the daily cap. For anything that materially affects what you earn or how you get paid, we will tell you in the app before it takes effect — not quietly in a version note. Continuing to use Kestrel after that is acceptance.
You can delete your account at any time from Settings. We may suspend or close an account for breach of these terms, suspected fraud, or if we stop operating the service. If we close the service entirely we will give notice and a window to cash out, including below the usual minimum.
Kestrel is provided “as is”. We do not warrant that the feed will always be available, that inventory will always be there, or that it will be free of errors.
To the extent the law allows, our total liability to you for any claim is limited to the greater of your unpaid balance or $100. We are not liable for indirect or consequential losses, including lost earnings you expected but had not yet earned. Nothing here limits liability that cannot lawfully be limited.
These terms are governed by the laws of California.
Before anything formal, write to support@kestreltv.com. Most disputes here are a ledger question and we can usually trace them in a day.
If any part of these terms is unenforceable, the rest still stands. Our not enforcing something once does not waive it. You may not transfer your rights under these terms; we may transfer ours if the business is sold, on notice to you.
